When you make purchases in our showroom or in the MY BENI AG online shop, you accept these terms and conditions and the data protection declaration, available on the website www.mybeni.ch/pages/datenschutz . Customers who shop in MY BENI AG stores are also obliged to comply with the house rules of MY BENI AG stores. Anyone who violates the house rules or an imposed ban on entering the premises will not be served and may be expelled from the business.

When placing your order, both in the showroom and online, you as a customer must provide truthful and complete information.

Subject of the contract, product characteristics

The subject of the contract are the goods identified in your order and listed in the order confirmation at the retail prices stated in the MY BENI AG showroom or online shop. Price and range changes, technical changes, errors and omissions are reserved, even if these affect the availability of the goods. The characteristics of the ordered goods are based on the product descriptions in the MY BENI AG showroom or in the online shop. Product images contained on the website may be incorrect. The colors in particular may vary for technical reasons. Images are for illustrative purposes only and may differ from the actual product. Technical data, weight, dimensions and performance specifications are given as accurately as possible but are subject to the usual variations. The absence of features described in the online shop does not constitute a defect in the products delivered to you.

The presentation of goods and prices in the MY BENI AG showroom and on the website is a non-binding (online) catalog and not a legally binding offer.

The purchase contract is concluded in our MY BENI AG showroom when you have paid the price for the goods and MY BENI AG has handed over the goods to you. If the price is obviously incorrect, MY BENI AG has the right to cancel the purchase of the goods and refund the purchase price. You have the opportunity to buy the goods new at the right price. When purchasing in our MY BENI AG showroom, the benefit and risk of the purchased goods pass to you immediately upon delivery of the goods.

Conclusion of the purchase contract in the online shop

The order you place in the online shop represents an offer to conclude a contract and can be freely accepted or rejected by MY BENI AG. The purchase contract will only be concluded if we send you a separate order confirmation by email within 5 days of placing your product order. The order confirmation is the official order confirmation. No contract will be concluded for ordered products that are not listed in the order confirmation; This may refer to products that are offered in the online shop but which, for example, can no longer be delivered at the time your order is received. If the price is obviously incorrect, MY BENI AG has the right to cancel the order for the goods and refund the purchase price. You have the opportunity to reorder the goods at the right price. If no contract is concluded, we will reimburse you for all payments already made. The benefit and risk of the ordered goods pass to you when the goods are handed over to the Swiss post office, a courier or another transport company.

Withdrawal from the purchase contract

After a purchase contract has been entered into, it can be canceled until 7:00 a.m. the next day.

Borrow items

You have the opportunity to rent a carpet in our store by providing your correct details (name, email, address, telephone number) and take it home with you to try it out for 7 days. The carpet must be returned to our showroom undamaged and on time. If this is not the case, we will invoice the price of the product in full.

In our online shop, sales are made exclusively to private customers who are at least 18 years old and have full legal capacity. By submitting your order, you accept this provision and confirm that you are authorized to purchase in order to comply with this regulation and the legal requirements for the protection of minors. Sales to private customers only take place in normal commercial quantities.

Prices, payment and retention of title

For orders in our MY BENI AG showroom and in our online shop, the prices stated at the time of the order apply. The prices stated are retail prices in Swiss francs (CHF) including VAT. Costs and fees for using certain payment methods are not included in the prices. Deliveries for Switzerland, EU and UK and the rest of the world are free. Payment for the items is made in the online shop using the payment methods shown in the ordering process, namely credit card (Visa, Mastercard, American Express), TWINT, ApplePay, PayPal, invoice or immediate payment (via Klarna), Heidi Pay or a gift voucher according to the conditions specified there. In our MY BENI AG showroom we also accept payment in cash or with a debit and credit card (all common cards accepted) and Twint. We reserve the right to exclude certain payment methods and, if necessary, to carry out a credit check for deliveries on account. If you pay by credit card, the invoice amount will be charged to your credit card upon completion of the ordering process. When paying by invoice, the invoice amount is due for payment and must be transferred within the specified payment period. If the payment has not been received by MY BENI AG within the deadline, you will be in default. The option of paying in installments is not available. If you are in default, MY BENI AG will charge a reminder fee from the first reminder after the payment reminder, which will be added to the outstanding amount plus late payment interest. The goods remain the property of MY BENI AG until full payment has been made.

Delivery for products from stock

You have the option of picking up the items ordered in the online shop in our showroom. If you do not pick up the ordered and paid items within 7 days of delivery - without contacting us again - MY BENI AG is entitled to take the affected items back into inventory and issue the customer a corresponding credit note. In such a case, the purchase price will be refunded and your right to receive the ordered items will expire.

Unless otherwise agreed, delivery will be made to the address you provided. Shipping takes place via Swiss Post or another delivery service selected by MY BENI AG to addresses worldwide.

Delivery is free for Switzerland, EU and UK and the rest of the world. The delivery times stated for shipping are for reference purposes only and are therefore only approximate. Disruptions not caused by us or a company commissioned by us (such as logistics companies for the fulfillment of the contract), as well as force majeure, may further delay delivery. We will notify you of any shipping disruptions as soon as we become aware of them. MY BENI AG is not liable for delivery delays caused by manufacturers, third parties or by force majeure.

When delivering from Switzerland to countries other than the EU, additional costs may arise when importing into the destination country (customs, VAT, duties or service fees). These additional costs vary depending on the local laws and regulations of the destination country as well as the weight and value of the shipment and will be charged to the customer or the recipient of the goods.

After 30 days of delay (after the 14 weeks) you can withdraw from the purchase. Return policy, exchange

Important: Discounted products are generally non-returnable. If you would like to test a carpet at home, please contact us in advance or shortly after ordering via info@mybeni.com or chat.

Returns for products from stock

You have the right to return purchased goods under the following conditions. The return period is 14 days from purchase of the goods in the showroom or from delivery of the goods when purchased in the online shop. This means that the goods may be returned in their original packaging, undamaged and unused within the period after the package arrives. You will receive the amount paid back after the goods arrive. You are responsible for the return transport.

Non-delivery or cancellation by MY BENI AG

If MY BENI AG cannot deliver the product you ordered, you will receive a notification by email. In the event of such non-delivery or cancellation, we will refund you the purchase price already paid for the goods using the payment method used for purchase. In the case of refunds from purchases on account, the amount will be credited to your corresponding account. In any case, the assertion of damages by you against MY BENI AG is excluded.

Default of acceptance by the customer

If you do not accept the goods delivered to you or do not collect them from the post office or a designated post office box within the deadline specified by the post office or delivery service, you will be in default of acceptance on the day after the attempted delivery or after the collection period has expired . Failure to accept delivery of goods in accordance with the purchase agreement does not release you from your obligation to accept such delivery and to pay in a timely manner all amounts owed under the purchase agreement. Warranty and Guarantee

The place of jurisdiction is the ordinary courts at the headquarters of MY BENI AG (Zurich).
